Privacy & Data Protection Policy

Lincolnshire Proficiency Test Committee (LPTC) are committed to complying with the General Data Protection Regulation (Regulation (EU) 2016/679). Looking after the personal information you share with us is very important, and we want you to be confident that your personal data is kept safely and securely.

LPTC is registered with the Charity Commission and our charity number is 514370.

LPTC is an approved City & Guilds Centre (Centre number 741186)

We have published this notice to help you understand

  • how and why LPTC collect information from you;
  • who we share your information with, why and on what basis; and
  • what your rights are.

If we make changes to this policy we will notify you by updating it on our website www.lptc.org.uk. LPTC will be what is known as the ‘Data Controller’ of the personal data you provide to us, and we will sometimes refer to ourselves in this notice as “we” or “us”. By Data Controller, this means LPTC determines the purposes and way in which any personal data are, or will be, processed.

What information we collect when you register and why

When you submit your completed Candidate Registration Form to LPTC you are entering into a contract with us. The information that you supply on the Candidate Registration Form will be:

  • full name
  • date of birth
  • address
  • email address
  • telephone numbers
  • employer contact details
  • details of particular assessment requirements
  • training provider details
  • who is responsible for payment of assessment

If you have made contact with us through our website our contact page requests the following information:

  • name
  • email
  • telephone numbers

How do we use your information?

We may use your personal data where this is necessary to pursue our legitimate interests as a provider of training, assessment and certification of City & Guilds products and/or services, including to:

  • undertake administration in relation to the qualification for which you are registered including providing you with a certificate on successful completion of your qualification or specified units of it.
  • contact you directly in relation to City & Guilds quality control purposes undertaken by City & Guilds for the qualifications for which the learner is registered; and investigations, appeals and complaints.
  • inform you of products or services offered by City & Guilds.
  • administer requests for reasonable adjustments under the Equal Opportunities and Access policy.
  • carry out statistical analysis (on an anonymised basis) which may be carried out by us.
  • to monitor (on an anonymised basis) equal opportunities and access relating to ethnicity or disability or other such monitoring purposes

Who we share your information with and why

We register your name, gender and date of birth with City & Guilds in order for you to receive training, assessment and certification. Other information such as address, email and contact numbers is required to administer quality assurance processes, investigations, complaints and appeals. LPTC and City & Guilds are both independent Data Controllers. City & Guilds sets out how they process your personal data through their Learner Privacy Policy located at www.cityandguilds.com/learner-policy

Where a Learner requires a reasonable adjustment, LPTC may be required to provide sensitive personal data about your health to City & Guilds for them to authorise the arrangements for the reasonable adjustment. Your consent will be obtained by signing the privacy notice on the Learner Registration Form.

The Service Providers contracted to us in connection with provision of learning, assessment and training products and services are invigilators, trainers and assessors. We provide them with only the information they need to perform the assessment and to confirm the identity of the learner, as per their contract with City & Guilds.

We may also share personal data with law enforcement or other authorities if required by applicable law.

How long we keep your information

We will retain personal data relating to your learning, assessment and certification for a minimum period of 3 years following learner certification, as per our contract with City & Guilds.

We will retain personal data relating to our quality assurance processes, appeals or investigations for a period of 7 years to ensure that we comply with any contractual, legal, audit and other regulatory requirements or any orders from competent courts or authorities.

Where do we store your personal data and how is it protected?

We take reasonable steps to protect your personal data from loss or destruction and LPTC regularly monitor technical and security measures to safeguard personal information. The data we hold is for the purpose of trading and corresponding with you. We will never pass on or sell this information to a third party without your express permission.

What are your rights ?

You are entitled to request the following from LPTC, these are called your Data Subject Rights and there is more information on these on the Information Commissioners website www.ico.org.uk

  • Right of access –to request access to your personal information and information about how we process it
  • Right to rectification –to have your personal information corrected if it is inaccurate and to have incomplete personal information completed
  • Right to erasure (also known as the Right to be Forgotten) – to have your personal information erased.
  • Right to restriction of processing – to restrict processing of your personal information
  • Right to data portability – to electronically move, copy or transfer your personal information in a standard form
  • Right to object – to object to processing of your personal information
  • Rights with regards to automated individual decision making, including profiling –rights relating to automated decision making, including profiling
